Terms and Conditions of Sale and Use
1. Introduction
This website is operated by EcoInnovation LTD, a New Zealand–registered company trading globally in New Zealand Dollars (NZD). Throughout this site and these Terms and Conditions, the terms “we”, “us” and “our” refer to EcoInnovation LTD.
EcoInnovation offers this website, including all information, tools and services available from it, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree, you must not access the website or use any services.
EcoInnovation reserves the right to improve or modify products at any time and to amend these Terms and Conditions without notice. Specific terms may apply to individual products or services and, where applicable, will override these general Terms and Conditions. We reserve the right to refuse service to any person for any reason at any time.
2. Safety
EcoInnovation takes the safe and responsible handling of its products very seriously. We endeavour to reduce risks associated with the use of our turbines and related equipment and warn users of potential hazards in product documentation.
Customers must familiarise themselves thoroughly with all installation manuals and verify correct installation, operation and maintenance procedures before commencing installation. Customers who disregard hazards or instructions outlined in manuals do so entirely at their own risk.
EcoInnovation is not liable for damage caused by incorrect installation, charge controller failure, or failure of other system components. Electrical generators and motors must be handled, installed and operated with extreme care. We strongly recommend that systems are installed by suitably qualified professionals.
Voltage thresholds for homeowner installation vary by country but are typically limited to 75 Vdc and 50 Vac. Some jurisdictions allow installations up to 120 Vdc. EcoInnovation does not recommend self-installation unless the installer is suitably qualified and experienced, and then only within these limits. Grid‑tied systems and higher‑voltage MPPT applications must be installed by approved renewable energy installers and must comply with all applicable legislation.
3. Customer Site Data & Communication
Many EcoInnovation products are manufactured specifically for individual sites. We may therefore require accurate site and system information to design and manufacture your product correctly. All hydro turbines require a valid calculation using the appropriate calculation tool.
Our ability to deliver a suitable and successful solution depends on the accuracy and completeness of the information you provide. Requests for information must be responded to promptly and respectfully. We reserve the right to refuse service where required information is not provided, is materially inaccurate, or where communication is abusive. In such cases, any refund will be subject to our refund policy.
4. Warranties
EcoInnovation warrants all products manufactured by EcoInnovation for a minimum of 12 months, unless stated otherwise.
Unless explicitly stated, all warranties are return‑to‑base warranties. Returned items must be shipped to EcoInnovation at the purchaser’s expense. Customers must review warranty terms carefully before submitting a claim.
PowerSpout warranty terms for complete hydro and pump products are provided in the relevant PowerSpout warranty documentation. Other EcoInnovation products have warranty details specified in their respective manuals.
If genuine parts are fitted correctly to PowerSpout products within the original warranty period, the original warranty remains valid. If genuine parts are fitted outside the warranty period, a 6‑month warranty applies to the replacement parts only.
Products supplied but not manufactured by EcoInnovation are covered by the original manufacturer’s warranty. EcoInnovation will honour such warranties where the manufacturer or supplier does so.
5. DIY Parts
DIY parts are supplied without warranty. Responsibility rests entirely with the designer or builder to ensure suitability for the intended application, including appropriate testing and validation.
6. Installation Warranties
EcoInnovation may install renewable energy systems in New Zealand or internationally, including remote locations. On‑site warranties may be offered for an additional annual fee and must be quoted separately.
Standard product warranties do not include on‑site service or repair. Unless otherwise agreed in writing, all goods must be returned to EcoInnovation for repair at the customer’s expense.
7. Payment
All invoices are issued in New Zealand Dollars (NZD). Currency conversions displayed for international customers are indicative only and based on mid-market rates. Final charged amounts depend on your payment provider’s exchange rates and fees.
Where payment is processed via Shopify, a 2% payment processing fee is charged by Shopify. If an order is cancelled by the customer, this 2% fee is non‑refundable, as Shopify does not return the processing fee to EcoInnovation. Any refund issued will therefore be net of this fee, to the extent permitted by New Zealand consumer law.
8. Taxes
New Zealand GST is charged only on goods shipped to a New Zealand delivery address.
Export orders are not charged New Zealand GST. International customers may be liable for GST/VAT, customs duties, and import fees upon arrival in their country. These costs are not included in product prices, freight, or insurance and are the responsibility of the purchaser.
9. PowerSpout Dealers
Where possible, customers are encouraged to purchase PowerSpout products through authorised dealers. Purchasing locally may provide benefits such as local currency invoicing, customs handling, local consumer protections, and in‑country technical support.
If no local dealer exists, we recommend purchasing through one of our GOLD dealers, who have the highest level of experience and can provide remote support.
10. Freight and Delivery
Freight Providers
Freight providers are selected based on destination, size, weight and value of the order. Restrictions apply to PO Box and counter deliveries. Where delivery details are incompatible with the selected courier, EcoInnovation may substitute an alternative provider.
Order Processing Times
Orders are processed on a queue basis following receipt of payment:
- In‑stock items (no manufacturing): 1–2 working days
- Out‑of‑stock items (no manufacturing): 5–10 working days
- Manufactured items: 2–15 working days
EcoInnovation is closed from the Friday before Christmas until the second Monday of the New Year. Orders placed during this period will be processed after reopening.
Freight Times
Freight times are additional to processing times and vary by destination and carrier. International delivery times exclude customs clearance delays.
Freight Insurance
Insurance coverage depends on freight method and order value. Where insurance is optional and not purchased, the customer accepts full freight risk.
11. Freight Damage
Goods must be inspected on delivery prior to signing. If damage is suspected, goods must be signed for as “damage suspected” or “goods damaged” and EcoInnovation notified immediately by email with photographs. Notification must occur within 5 working days of receipt.
Failure to comply may result in loss of insurance coverage. Replacement goods will only be supplied where insurance coverage applies. Freight carrier terms and conditions apply in all cases.
12. Limitation of Liability
Service Liability
EcoInnovation’s liability for paid professional services is limited to three times the professional fees charged, unless otherwise agreed in writing. Advice provided free of charge carries no liability.
Product and Installation Liability
EcoInnovation complies with the New Zealand Consumer Guarantees Act where applicable. “Prompt action” under this policy is defined as 21 days or less. Custom‑made products are not consumer goods and are not eligible for return under consumer law.
EcoInnovation is not liable for damage arising from customer or third‑party installation, misuse, or failure to comply with installation instructions or legal requirements. Customers are responsible for arranging their own insurance once goods are received and confirmed to be free of defects.
EcoInnovation is not liable for consequential damage arising from regulator failure or other equipment failure, even where such equipment is under warranty.
13. Regulations
Customers must comply with all applicable electrical and safety regulations in their jurisdiction. EcoInnovation is not liable for breaches of local laws by customers or third‑party contractors.
14. Returns
All returned goods must:
- Be undamaged and in original condition
- Include original packaging
- Include a copy of the invoice
- Include written instructions regarding exchange, credit or refund
Return Authorisation and Timeframe
When a purchaser notifies EcoInnovation of their intention to return goods under these Terms and Conditions, and EcoInnovation agrees to the return, the goods must be received by EcoInnovation within 14 days of that agreement. Failure to return goods within this timeframe may result in termination of the purchaser’s right to return, except where rights arise under the New Zealand Consumer Guarantees Act.
Customer‑Initiated Cancellations and Returns
Where a return or cancellation is initiated by the customer and is not due to a fault with the goods, EcoInnovation may deduct reasonable and unavoidable costs incurred in processing the order and payment, including non‑refundable payment processing fees charged by third‑party providers such as Shopify, to the extent permitted by New Zealand consumer law.
Goods Sent Incorrectly by EcoInnovation
Items sent incorrectly by EcoInnovation will be fully refunded, including original freight costs, provided return conditions are met.
Goods Ordered Incorrectly by the Customer
EcoInnovation reserves the right to charge a processing fee where orders are placed incorrectly, site data is inaccurate or incomplete, delivery details are incorrect, or goods are returned without product fault. Refunds in these cases are subject to the refund policy.
15. Faulty Goods
All faulty goods must be returned to EcoInnovation for assessment unless otherwise stated in the specific product warranty terms. A refund or replacement will only be issued where the item is determined to have a manufacturing fault.
Refunds or replacements will not be issued for products that have been:
- Misused
- Incorrectly installed or commissioned
- Used for research and development (R&D) or DIY development purposes
EcoInnovation reserves the right, at its discretion, to refund, replace with an equivalent product, or repair the item.
16. Refunds
Refund values exclude all freight charges incurred by EcoInnovation.
- For stock items not yet dispatched, a processing fee of $100 or 10% of the order value (whichever is greater) will be deducted from the refund amount.
- Custom-made items are non-refundable, but customers are encouraged to contact EcoInnovation to explore a resolution in good faith.
- Goods sent with free freight (including DIY bundles or dealer-supplied items) will have the original freight cost deducted from any refund.
Example Refund Calculation
If a customer places an order for $1,000 NZD, cancels the order prior to dispatch, and the goods are not faulty:
- Shopify payment processing fee (2%): $20
- Processing fee: $100
- Total deductions: $120
- Refund issued: $880 NZD
17. Disputes
Customers must first contact EcoInnovation to allow us the opportunity to resolve any issues. EcoInnovation will work in good faith to achieve a fair resolution.
For disputes in New Zealand involving consumer goods (excluding customised solutions), customers have rights under the Consumer Guarantees Act and contract law to seek adjudication through the Disputes Tribunal. EcoInnovation will comply with any Tribunal ruling within 24 hours of the decision. Customers must initiate any Tribunal action themselves but must give EcoInnovation a reasonable opportunity to resolve the matter first.
18. Accuracy, Completeness and Timeliness of Information
EcoInnovation is not responsible if information provided on this site is inaccurate, incomplete, or outdated. Information is provided for general purposes only and should not be relied upon without consulting more accurate, complete, or timely sources.
Historical information on this site is for reference only. EcoInnovation may modify site content at any time without obligation to update existing information. Users are responsible for monitoring changes.
19. Intellectual Property Rights
All intellectual property rights in this site, including copyright in text, graphics, logos, software, and icons, are owned by or licensed to EcoInnovation.
Except as expressly permitted, no content from this site may be copied, adapted, stored, distributed, or reproduced without prior written consent from EcoInnovation.
20. Errors, Inaccuracies and Omissions
Occasionally, site information may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability.
EcoInnovation reserves the right to correct errors, inaccuracies, or omissions and to change, update, or cancel orders if information is inaccurate, at any time and without prior notice, including after an order has been submitted.
21. Privacy Policy
EcoInnovation’s Privacy Policy governs the collection and use of personal information and applies to all use of this website. The Privacy Policy is available separately on this site.
