This website is operated by EcoInnovation. Throughout the site and in these Terms and Conditions, the expressions “we”, “us” and “our” refer to EcoInnovation LTD. EcoInnovation offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. EcoInnovation reserves the right to improve our products at any time and may need to alter these Terms and Conditions without notice. Specific Terms and Conditions may apply to individual products and services and may override these. We reserve the right to refuse service to anyone for any reason at any time.

EcoInnovation LTD is an New Zealand registered company transacting globally in $NZ.

Safety

EcoInnovation takes the safe and responsible handling of our products very seriously. We endeavour to reduce all risks associated with the use of our turbines and warn you of potential hazards in our product documentation. It is essential that customers thoroughly familiarize themselves with the installation manuals and check correct installation, operation and maintenance procedures and protocols before commencing installation. Customers that disregard the hazards and advice outlined in manuals do so at their own risk.

EcoInnovation is not liable for damage caused by incorrect installation, charge controller failure or failure of other system components. Electrical generators and motors must be handled, installed and run with the utmost caution. EcoInnovation recommends that you have a professional install your system.

In many countries owners can install electrical equipment up to certain voltages. This varies around the world and is typically 75 Vdc and 50 Vac. Some countries also allow 120 Vdc installations by homeowners. We do not recommend that you attempt to install this equipment unless you are suitably qualified and experienced to do so, and then only up to 75 Vdc/50 Vac. Grid-tied and higher voltage MPPT applications of the PowerSpout products must be installed by an approved renewable energy installer and comply with relevant legislation.

Customer Site Data & Communication

As many of our products are made specifically for you and your site we may require information from you about your site and your system in order to build the product you have ordered. It is important to EcoInnovation and its values that every installation of its products are a success. Your satisfaction with our product and our ability to provide you with appropriate solutions is dependent on the accuracy of the information you provide us. All hydro turbines require a valid calculation from the appropriate calculation tool.

Any requests we make for information need to be replied to in a prompt and polite manner. We reserve the right to refuse service to anyone who does not provide us with the information we require to build the product they have ordered or who communicates in an abusive manner. In such cases customers will be subject to our refund policy.

Warranties

EcoInnovation warrants all products made by EcoInnovation for a minimum of 12 months unless stated otherwise.

Unless stated otherwise, all warranties are “return to base” and must be shipped back to us at the buyer’s expense. Please ensure you have thoroughly read this policy before submitting a claims form.

All products made by EcoInnovation but not covered in the document linked above will have their warranties detailed in their respective manuals.

If genuine parts have been correctly fitted to PowerSpout products still under warranty then the original warranty is still valid on the whole product. If genuine parts have been fitted to PowerSpout products outside warranty then a 6-month warranty applies to the replacement parts only.

Each piece of equipment supplied by, but not manufactured by, EcoInnovation will have documentation that outlines the manufacturer’s warranty. EcoInnovation will honour manufacturer’s warranty where the manufacturer or supplier honours it.

DIY Parts

DIY parts have no warranty; it is for the designer of the machine to ensure that parts used are suitable for the final product or solution by undertaking appropriate endurance testing.

Installation Warranties

EcoInnovation sometimes installs renewable energy systems in very remote parts of NZ and the world. EcoInnovation can offer onsite warranties for an extra annual fee. Please ask us to quote you if you wish to consider onsite warranty options. Any warranty on equipment does not include onsite service/repair. Goods must be returned to EcoInnovation for repair at the client’s expense.

Payment

All invoices issued by our Xero accounting system are in New Zealand Dollars. Global clients can view prices in their local currency (other than $NZ) but need to be aware that these conversions are based on mid market rates. The amount that you are charged will depend on your credit card providers own rates and will vary slightly from the prices shown by the currency converter.

Taxes

New Zealand GST (Goods & Services Tax) is calculated only for goods shipped to a New Zealand address during checkout. No export order is charged GST or local destination country taxes.

For goods shipped to global destinations, be aware that you may incur GST/VAT, local taxes, custom fees and import duty once the goods arrive in your country. We recommend that international customers call their local customs office to determine what these fees are likely to be. All freight, shipping and insurance costs payable on this website exclude these fees.

PowerSpout Dealers

Where possible we encourage you to buy PowerSpout products through one of our authorised dealers. Our dealers have the knowledge and experience to help guide you through a successful installation.

Buying from a dealer in your own country has the following advantages:

  • Invoice in local currency including local taxes
  • Clear customs and pay any import duties on your behalf
  • Local country consumer law protection (where relevant)
  • Dealer support from within the country

If there is not a dealer in your country we recommend buying from one of our GOLD dealers as they are our most experienced dealers and they can advise you through most things via email.

NZ Customers - please note that Aramex Couriers cannot deliver to PO Boxes or post office counter delivery. If the postal address supplied is a PO Boxes or post office counter delivery we will use NZ Post.

Order Processing Times

We processes orders using a ‘queue based’ system and the queue length varies depending on seasonal demand. When ordering items on this site, please allow for these timeframes to avoid disappointment. The following time schedules apply following receipt of payment:

  • In stock item/s that require no manufacturing by EcoInnovation are processed within 1-2 working days.
  • Out of stock item/s that require no manufacturing by EcoInnovation are processed within 5-10 working days.
  • Items that require manufacturing by EcoInnovation are processed within 2-15 working days.

We are closed from the Friday before Christmas (25th December) and reopen on the 2nd Monday in the New Year. When placing an order please allow for this holiday closedown period.

Freight Times

Freight times are in addition to order processing times.

  • New Zealand shipping times are 1-5 working days depending on freight service and your location in NZ.
  • International shipping times by DHL Express are typically 3-7 working days excluding any customs clearance delays. DHL Express is a tracked service.
  • International shipping times by NZ Post are typically 2-3 weeks excluding any customs clearance delays. NZ Post is a postal service and items sent are not tracked.

Freight Insurance

International orders below $250 NZD which are sent by NZ Post and are covered by NZ Post insurance.

International orders which are sent by DHL are sent without freight insurance unless you purchase DHL insurance at the time you place your order. Failure to purchase DHL insurance will result in you accepting the freight risk yourself.

New Zealand orders below $250 NZD sent by NZ Post and are covered by NZ Post insurance.

New Zealand orders sent by either Aramex Couriers or TIL Logistics are covered up to $2000 NZD. If you require additional insurance then it is your responsibility to arrange this.

Freight Damage

In all cases the client must receive and check that the goods have not suffered transit damage prior to signing that they have been “received in good condition”. In all instances where external damage is suspected or evident we require that clients sign and state “damage suspected” or “goods damaged”. Even if obviously damaged you will need to accept the goods and immediately contact us by email (with pictures). We must receive this information within 5 working days so a claim can be made with the insurance company. Failure to act in a prompt manner after receiving the goods will result in delays and the possible loss of any insurance cover.  

In the event of freight damage the customer is required to cooperate fully with EcoInnovation staff to resolve the issue promptly. Replacement goods will only be sent if the goods were insured. The Terms and Conditions of the freight company apply in every case where an item is shipped to a customer, see DHL terms and conditions and NZ Post terms and conditions.

Re-Freighting

If re-freighting the goods to another destination you must take out insurance cover for this additional freight leg and re-pack the goods suitably for the freight method. All re-freighted goods must be double boxed and those above 25kg should be also put on a pallet. Goods sent by us are suitably packed only for a single airfreight journey to the destination address on the invoice.

Limitation of Liability

Service Liability

EcoInnovation is liable for damages up to three times the professional fees charged, unless contracted otherwise. Advice offered for free and where no separate consultation fee has been paid, has no liability attached.

Product Liability

For customers within New Zealand EcoInnovation adheres to the New Zealand Consumer Guarantees Act in terms of product liability. In this Act, “prompt action" is required by the consumer in order for a return to be processed. EcoInnovation defines “prompt action" as 21 days or less. Customized items that are made especially to order, are NOT considered consumer goods, and therefore are not eligible for return or covered by NZ Consumer Law.

Liability for customer or third party installation

Once goods are received and deemed without fault, it is the client’s responsibility to organise their own insurance cover for accidental damage and theft of equipment.

EcoInnovation is not liable for the results of any work undertaken on a renewable energy system by any other party unless that party is engaged by EcoInnovation to do the work in question.

Many homeowners attempting to install a renewable energy system themselves can, and often do, make serious errors. EcoInnovation is not liable for any damage whatsoever due to incorrect installation by the customer or any third party contracted by the customer. If you are uncomfortable undertaking this liability, please engage a qualified renewable energy installer to do any installation work required and check that their terms of engagement meet your requirements.

Consequential damage

EcoInnovation is not liable for consequential damage caused by regulator or other equipment failure (even if the equipment is under warranty and supplied by us). It is the owner’s responsibility to check correct operation and/or install extra protection to reduce the risk of consequential damage. The client should undertake appropriate insurance cover for consequential damage.

Regulations

New Zealand Electrical System Regulations

On systems that have a running voltage greater than 50Vac or 120Vdc, the purchaser must have it installed by a registered electrician. A registered electrician must do 230Vac inverter wiring. EcoInnovation is not liable for any infringement of applicable laws by the customer or third-party contractor.

Global Electrical System Regulations

Unlike NZ and Australia most other countries only allow DIY installation of renewable energy equipment that have a running voltage less than 50Vac or 75Vdc. Overseas customers must check their own wiring regulations as they vary from country to country.

Please find out who is legally allowed to install or work on your electrical system before any such work is undertaken. EcoInnovation is not liable for any infringement of applicable laws by the customer or third-party contractor.

Returns

All products being returned must meet the following conditions to qualify for an exchange, credit or refund:

  • Undamaged and in original condition
  • Packaged with all of the original packaging
  • Including a copy of the invoice
  • Including a note explaining your exchange or credit requirements

Goods sent incorrectly by EcoInnovation

Any item sent incorrectly by EcoInnovation (not ordered incorrectly or in error) will be fully refunded (including freight fees) provided the return conditions above are met.

Goods ordered incorrectly or in error by you

We reserve the right to charge a processing fee if you place an order incorrectly, in error, give an incorrect delivery address, refuse to provide site data, provide inaccurate site data, want to return goods or cancel order without fault of the product. In such cases our refund policy applies.

Faulty Goods

All faulty goods must be returned to us for assessment unless we state otherwise in the specific product warranty terms. A refund/replacement will only be issued in the case where the item is deemed to have a manufacturing fault.

We do not issue refunds/replacements for products that have been:

  • Misused
  • Incorrectly installed or commissioned
  • Used for R&D or DIY development type work

We reserve to right to refund, replace with an equivalent or repair at our discretion.

Refunds

If the item is a stock item a processing fee of $100 or 20% (whichever is the larger) will be deducted from the refund value provided the goods have not yet been dispatched from EcoInnovation.

On items specially made to order for you no refunds will be given. You must contact us and will we try and find a resolution. In the event of a dispute we will work in good faith to find a resolution which is fair to both parties.

Refund value excludes all freight charges we have incurred.

Goods that were sent “free freight” as a DIY bundle or through a dealer, will have the freight cost paid by us deducted from the refund value.

Disputes

If you have an issue you must contact us and will we try and find a resolution. In the event of a dispute we will work in good faith to find a resolution which is fair to both parties.

In the event of a dispute in NZ you have rights under the Consumer Guarantees Act (if the item is a consumer item – excludes customised solutions) and contract law that you can have an adjudication on in the Disputes Tribunal. EcoInnovation will abide by the ruling within 24 hours. You must initiate this action, before doing so please give us the opportunity to see if the matter can be resolved first.

Accuracy, Completeness And Timeliness Of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Errors, Inaccuracies And Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
